In accordance with article 89, section XII of the Constitution of Mexico, which specifies that the powers and duties of the President include:
Help out the judiciary in the expeditious execution of its functions.
As well as in the exercise of our right of reply, which is still being denied to us by the media serving as a forum to María Isabel Miranda Torres,
The Canadian Association for Rights and Truth, a non-profit civil organization duly incorporated in Montreal, Canada, and through its President David Bertet, addresses to you to express the following:
At the press conference that María Isabel Miranda Torres, President of the pseudo civil organization Alto al Secuestro (Stop the Kidnappings) held on July 13, 2016, she falsely alleged that she had received threats from her son’s kidnappers and those defending them.
María Isabel Miranda Torres did not formally accuse the Canadian Association for Rights and Truth, nor did she formally put the blame on us, as she is used to doing, and as she has done so in such a gross manner with people whose faces she shamelessly showed in billboards put up by her Showcase company in 2006, with the sole purpose of deceiving the Mexican public opinion and make it believe that her son Hugo Alberto Wallace Miranda had been kidnapped. It should be noted, Mr. President, that the sub-thesis concerning the dismemberment of her son arose at that time, between January and February 2006. Any story, even the most fanciful one, requires certain time of development.
The President of Alto al Secuestro, throughout her “work” as “activist,” has devoted herself to destroying innocent people, Mexican and foreign citizens, victims of the failures of your country’s judicial system, and to present them as criminals—word which it seems she believes to have the monopoly on—in violation of the fundamental principles that govern each constitutional state as Mexico is supposed to be. In addition, this woman, with the inexperience and incompetence that characterizes any populist who imagines himself or herself as king or queen, has at her disposal nothing more than statements of dubious origin.
María Isabel Miranda Torres tries to divert public attention by claiming that she has received threats from our press conference. The association of anonymous activists Mexico por Florence Cassez has exposed the falsehood of these threats, probably manufactured by who allegedly received them. To temporarily close the theme of the arbitrary accusations by María Isabel Miranda Torres against the authors—if any—of the so-called threats against her, we assert that for María Isabel Miranda Torres to invoke alleged threats instead of answering directly and without digressing from the elements presented by our organization only proves the ease with which she was able to create the character of the heroic Mother Courage and claim the victim status when she wasn’t one. The Canadian Association for Rights and Truth will be vigilant against any attempt of manufactured accusations against us, the victims we defend, or their relatives, by her and the Attorney General’s Office, institution that in our opinion should investigate itself regarding: (1) the likely involvement of several of its members in the manufacturing of the Wallace case; (2) the incredible and shameful number of accusations of torture against its staff filed before the CNDH (National Human Rights Commission) and international bodies.
Returning to the theme that we are really concerned with herein, that is, the manufacturing of the Wallace case, and the likely participation of the family of the missing person in the crimes involved in such manufacturing: At her press conference, María Isabel Miranda Torres did not answer any of the evidence that we presented at our press conference of July 11, 2016, anniversary day of the supposed date of the kidnapping of her son Hugo Alberto in 2005. Had she convinced us of the reality of the kidnapping of her son, of the culpability of those indicted, and of the legality of the process against these, CART and its President would have publicly recognized their error, assumed the consequences of this error, and apologized to Mrs. Miranda Torres. However, in light of the content of the press conference that the President of Alto al Secuestro presented on July 13, 2016, we will not present any apology, nor we will withdraw anything said in our conference; and to paraphrase what María Isabel Miranda Torres herself said at her conference: “You are not going to get us out of your way. Only by killing us.”
On the other hand, during the press conference, María Isabel Miranda Torres presented the video of a statement made by the defendant César Freyre Morales, accused of forming part of the gang of kidnappers of Hugo Alberto Wallace Miranda. In that video, one can see an undernourished César Freyre Morales claiming that he was neither tortured nor pressured to testify. This statement dated October 2010 turns out to be very well known by us, the Canadian Association for Rights and Truth having investigated what happened in the Campo Marte military facilities before this statement was made. We affirm with proof in hand that César Freyre Morales was tortured to testify before the judge that he had never been tortured.
If we had some confidence in the Attorney-General’s Office, if such an institution, intended to serve the interests of Mexican citizens, had demonstrated its professionalism and its respect for the law through a real follow-up of the complaints filed by the families of the victims in the Wallace case, our organization would have surely asked that what happened prior to the declaration of César Freyre Morales before the judge be investigated, as well as the origin of the videos of interrogations, probably illegal, which through different YouTube accounts have been diffused on the web: Jacobo Tagle Dobin, Juana Hilda Lomelí, César Freyre Morales, appear in these videos. Furthermore, we want to emphasize that the habit of creating videos in which individuals self-incriminate was one of the characteristics of the AFI (Federal Agency of Investigation) and the Federal Police, infamous for their media montages.
Let us not forget that María Isabel Miranda Torres has not answered any of the allegations that we presented during our press conference. None. In his speech, the President of the Canadian Association for Rights and Truth put aside any talk concerning the allegations of torture to focus his arguments only on other evidence elements, conclusive elements that were duly submitted to the authorities that, in an extremely incompetent and negligent manner, until now have refused to investigate. In our opinion, the burden of proof rests heavily upon the prosecution, including the family of the missing person, of whom we have signs of life up to 2010, and the public prosecutor’s office. It is not incumbent upon the accused the task of proving their innocence. We have to accept, Mr. President, that the institutions of the State you head paid absolutely no attention to them. Even so, it is precisely what CART is doing, demonstrating the hollowness of the alleged evidence that the mother of the missing person seeks to assert.
The confessions aimed at impacting the public opinion are a remnant of another era. An era in which, the arbitrary power of the State had no limits. An era in which individuals that unwillingly played the role of scapegoats were burned in public. An era proper of Inquisition times would have never resurfaced in a constitutional State as a modern Mexico is presumed to be. However, the image of María Isabel Miranda Torres reminds us that that barbaric era may recur continuously. An era in which it was sufficient for a powerful public figure to send individuals to jail, to subject them to group violence, on the sole basis of the charisma and the authority of that character. It is our duty as conscious, righteous and human beings, to anticipate the comeback attempts of barbaric acts and protect citizens against arbitrary power.
Mr. President, the rule of law will remain at risk until figures from the Inquisition, as María Isabel Miranda Torres tries to be, stop playing their shameful and outrageous role of public prosecutors in the delivery system of Mexican justice.
CART, through its President, maintains firm its position clearly expressed during the press conference of July 11, 2016:
(1) The Mexican State has the duty to protect the victims against any form of arbitrary power.
(2) The Mexican State is obliged to comply with the requirements of scrupulous respect and without exception of all basic principles of every individual; to prevent and punish violations of human rights, among them the violation of the presumption of innocence and the absolute prohibition of acts of torture.
(3) We invite the Mexican State to urgently proceed to the creation of an independent parliamentary commission focused on investigating in an objective manner the Wallace case as well as referred cases in which María Isabel Miranda Torres intervened directly or indirectly through her pseudo organization Alto al Secuestro, among them the Martí case.
Finally, Mr. President,
(4) In accordance with article 89, section XIV of the Constitution of Mexico, we are kindly asking of you to open to us the way towards the presidential pardon or amnesty for Jacobo Tagle Dobin, César Freyre Morales, Brenda Quevedo Cruz, Jael Malagón Uscanga, Juana Hilda Lomelí, Tony and Albert Castillo.
We have committed ourselves not to give María Isabel Miranda Torres the media attention that she wants to be given, since she is not a human rights activist but a defender of hidden interests, foreign and contrary to human rights. We will be satisfied expressing, just as she recently did: we are not afraid of anyone. Sooner or later, there will be justice for all, regardless of whichever power is supporting fake activists such as María Isabel Miranda Torres.
We express our hopes, representing the noblest aspirations of the Mexican people to justice, to the law for all, and to truth, that finally, after 11 years of lies in the Wallace case, the rule of law will prevail.
